زواج القاصرات بين المقصد والمآل

Abstract: The research aims to clarify the concept of marriage of minors and its ruling in Sharia and law and linking it to purposes and outcomes Clarifying the marriage of minors and the difference between a minor and a minor, Ruling on the marriage of minors between Sharia and law, Linking the purposes of marriage to its consequences and applying it to the marriage of minors.

The researcher concluded that the marriage of minors is permissible and legitimate, and the contract for minors is valid, but the first failure to marry minors does not achieve the purpose for which the marriage was initiated, and the health, psychological, and social effects it entails.

المستخلص: يهدف البحث إلى توضيح مفهوم زواج القاصرات وحكمه في الشريعة والقانون وربطه بالمقاصد والمآلات، ويقوم هذا البحث على المنهج الوصفي التطبيقي المقارن، فيتم فيه استقراء المقاصد وربطها بالمآلات وتطبيقها على زواج القاصرات، ويتمحور هذا البحث  حول توضيح زواج القاصرات والفرق بين القاصر والصغير، وحكم زواج القاصرات بين الشريعة والقانون، ربط مقاصد الزواج بمآلاته وتطبيقه على زواج القاصرات. 

وقد خلص الباحث إلى أن زواج القاصرات جائز ومـشروع، والعقـد علـى القاصرات عقد صحيح، لكن الأولى عدم تزويج القاصرات كونه لا يحقق المقاصد التي شرع الزواج من أجلها، ولما يترتب عليه من آثار صحية ونفسية واجتماعية.
