الإمام “المقري الجد” وإسهاماته في مجال القواعد الفقهية

The Imam (Al-Muqri the grandfather) isconsideredone of the scholars of the MalikiFiqhSchool, which made every effort in his service, especially in the field of jurisprudence rules, whereheworkedthroughhis groups to formulate jurisprudence in the form of preciserules to facilitateits use and facilitatereference to it, and to clarify and rootitsothatitdoes not remainwide and wide, Althoughitis one of the most important sources of jurisprudence withabundance, benefit and simplicity of its style, it has not receivedmuch attention fromstudents of this science and itsfollowers, in the past and present. Therefore,I intend in this article to explain the contributions of the imam, mayGod have mercy on him, in the field of rules of jurisprudence, whichenriched the MalikiFiqhlibrary, in the first part of the search, I gottoknow Imam al-Maqri, including the erawhichhelived, and in relation to the second part: I spoke about the subject of jurisprudence rules as astand-alone science, then I spoke about his contributions in theend of the research, I followed in this research the descriptive method, as it is consistent with this type of studies, with regard to the description of Imam al-Maqri, as well as his works in the field of jurisprudence. يعتبر الإمام المقري الجد من أوعية المذهب المالكي الذين بذلوا قصارى جهدهم في خدمته، خاصة في مجال القواعد الفقهية، إذ عمل من خلال مصنفاته فيها على صياغة الفقه في شكل قواعد مضبوطة تيسيرا للاستفادة منه وتسهيلا للرجوع إليه، وعملا منه على توضيحه وتأصيله حتى لا يبقى واسعا فضفاضا، ورغم كونها من أهمّ مصادر الفقه مع غزارة نفعها وبساطة أسلوبها، إلا أنّها لاقت قلة اعتناء من طرف طلبة هذا العلم ومرتاديه قديما وحديثا.  ولهذا عمدت في هذا المقال إلى التعريف بالإمام رحمه الله، وتبيين إسهاماته في مجال القواعد الفقهية التي أثرى بها المكتبة الفقهية المالكية علّها تحظى بدراسات وأبحاث تليق بقدرها ومقامه فيما يستقبل من الزمن، إذا لا بدّ فيها من مزيد عناية واهتمام، وقد قسمت البحث إلى مباحث ثلاثة: تطرقت في الأول منها إلى التعريف بالإمام المقري بما في ذلك العصر الذي عايشه، أما فيما يتعلق بالمبحث الثاني: فقد تناولت موضوع القواعد الفقهية باعتبارها علما قائما بذاته، ثمّ وقفت على إبراز إسهاماته في هذا المجال في المبحث الأخير، وقد اتبعت في هذا البحث المنهج الوصفي كونه يتماشى مع هذا النوع من الدّراسات وذلك فيما يتعلق بوصف الإمام المقري وكذا مصنفاته في مجال القواعد الفقهية. الكلمات المفتاحية: المقري الجد – القواعد الفقهية – الفقه المالكي – الإسهامات.
