التكييف الفقهي للشركة المساهمة ومشروعيتها في الفقه الإسلامي

This study discusses the joint-stock company issue regarding its definition, its regulations, its qualification, and its legality in Islamic jurisprudence. This research is distinguished from other studies that shed the light on the same issue by dealing with the jurisprudential qualification for the joint-stock company, its legality, and the different opinions of the jurisprudents regarding its legality and discussing the legality proofs  Then, the research explains which opinion outweighs others. the paper also explains both the jurisprudential and legal definitions of the joint-stock company and its regulations. تناولت هذه الدراسة موضوع الشركة المساهمة من حيث مفهومها وضوابطها وتكييفها ومشروعيتها في الفقه الإسلامي، وهدفت إلى بيان التكييف الفقهي لهذه الشركة، وبيان مشروعيتها، وسلك الباحث المنهج الوصفي الذي يقوم على تتبع المعلومة واستقراء الجزئيات وصولاً للأحكام العامة، بالإضافة إلى مقارنة آراء الفقهاء في مشروعية الشركة المساهمة وأدلتهم ومناقشة الأدلة، ثم بيان الرأي الراجح، وتوصل الباحث إلى جواز المساهمة في الشركة المساهمة إذا خلت من الربا ومن كل ما حرم الله تعالى، ثم ختمت الدراسة بخاتمة تضمنت أهم النتائج والتوصيات. الكلمات المفتاحية: التكييف، الشركة، مشروعية، الفقه، القانون.
