The approach depends on the analysis and discussion of what each team went to, while indicating the amounts of symbiotic punishments in the atonements such as food and clothing. The conclusion of the research sums up the most important findings of this research as well as recommendations. هدف هذا البحث إلى مناقشة العقوبات التكافلية في التشريع الاسلامي- الكفارات أنموذجاً- دراسة مقارنة، ويتناول تعريف أحكام العقوبة في التشريع الإسلامي، وأحكام التكافل في الإسلام، مع بيان أحكام العقوبات التكافلية في الكفارات ودورها الإيجابي في التكافل الاجتماعي، وأراء الفقهاء في العقوبات التكافلية، وهل هذه الكفارات عقوبات تكافلية وهل هذه جوابر وزواجر في آن واحد، وتناول البحث أنواع الكفارات التكافلية ونوع التكافل في كل كفارة على حده، كما هدف البحث إلى بيان تحليل الأدلة الشرعية المتعلقة بالعقوبات التكافلية في الكفارات في التشريع الاسلامي، ويعتمد هذا البحث على المنهج الاستقرائي والتحليلي وذلك باستقراء أقوال فقهاء الشريعة الإسلامية في حكم الكفارات وأحكامها، مع تحليل ومناقشة ما ذهب إليه كل فريق منهم، مع بيان مقادير العقوبات التكافلية في الكفارات كالإطعام والكساء وأخيراً خاتمة البحث وتضمنت أهم النتائج التي توصل إليها هذا البحث وأهم توصيات البحث. الكلمات المفتاحية: العقوبة- التكافل– الكفارة – اليمين – النذر – القتل – الظهار- المد – الصاع.
